Legal scholarship lacking on health care

Our country’s founding fathers defined congressional power in Article I, Section 8 of the Constitution as regulating commerce with foreign nations, and among the several states, and with the Indian tribes.

Those backing “Obamacare” are using this Interstate Commerce clause to justify requiring individuals buy health insurance from an insurer in their state.

One does not have to be a legal “scholar” to questions its applicability.
